This part is from 2021 The words are as I wrote them then. I've only broken the paragraphs up to make it readable and cut the channel plugs. Rules, costs and timelines have all moved since, so don't take it as current.

To qualify for a US visitor visa, in other words a tourist visa, you have to establish that you do not have "immigrant intent", a plan to remain in the US permanently. That is a basic component of most temporary US visas. The American government wants to know you will leave before your visa or I-94 expires.

So if you are coming to America on a tourist visa intending to immigrate, meaning you plan to stay for good, this one is not for you.

This is for people who are already in the US as tourists and who, for some reason, cannot go home. A family member here has fallen ill, or your wife is pregnant, or you yourself have become sick. There can be all sorts of reasons. The point is that when you entered as a tourist you did not know about it. You can treat that as unforeseen circumstances. And you have a close relative here who is a permanent resident or a citizen.

I'll say it again: if it is established that you entered the US with the intention of immigrating, you will not be given the chance to change your visa and settle here. You will have to go back to your own country and process from there.
